Going with Emerson Migration Law was hands down the best decision I and my partner ever made.
The #1 Migration Agents in Brisbane for Partner Visa Applications
If you are in a married, de facto, or same-sex relationship with:
- An Australian citizen,
- An Australian Permanent Resident, or
- An eligible New Zealand citizen,
you may be eligible to apply for a Partner Visa, opening the door to Australian Citizenship.
Partner Visa Types
The different types of partner visas are known by different ‘subclasses’. Each subclass has its own set of criteria that must be satisfied in order for it to be granted.
If you are outside Australia at the time of applying, you will need to make an application for a combined 309/100.
The Partner (Provisional) visa (subclass 309) is a temporary visa that allows you to live in Australia until your permanent Partner visa (subclass 100) application is accepted.
After two years, you can apply for a permanent Partner visa (subclass 100).
Who can apply?
Individuals in a genuine relationship with their Australian sponsor.
Basic Requirements:
- Be in a genuine and ongoing relationship with an Australian sponsor.
- Must be married or in a de facto or same-sex partnership.
- Pass health and character checks.
- Sponsored by an eligible partner.
How we can assist you:
When applying for a partner visa, a professional migration agent at Emerson Migration Law will prepare your application for both temporary and permanent visas.
- Initially, you will receive a temporary partner visa (subclass 309), which will allow you to stay in Australia while the decision on your permanent visa (subclass 100) is pending.
- Approximately two years after your initial application, if you are still with your spouse or de facto partner and meet all the requirements, you are likely to be granted a permanent visa.
If you are inside Australia at the time of applying, you will need to make an application combining both subclass 820 and 801.
Who can apply?
Overseas individuals in married couples, de facto or same-sex relationship with an Australian citizen, permanent resident, or eligible New Zealand citizen.
Basic Requirements:
- Be in a genuine and ongoing relationship with an Australian sponsor.

This, however, is only a temporary visa, and the applicant will need to apply for a permanent partner visa once married.
